Payment processing and invoicing are carried out as Merchant of Record by our payment processor Paddle.com. Paddle calculates and remits any applicable sales/consumption taxes (e.g. VAT/GST/Sales Tax); buyers receive the invoice directly from Paddle. For questions regarding payments, refunds or invoices, please first contact Paddle support.

1. Scope of Application

These Terms and Conditions govern the sale of digital art graphics (“print templates”) as well as click purchases for the generation of new works (collectively referred to as “works”) by cyc4arts OÜ to consumers via download or provision as digital content.

2. Conclusion of Contract & Prices

  • All offers are non-binding. A contract is concluded upon successful payment and provision of the download link or confirmation of the generation order.
  • Prices are stated in Euro (€/local currency). Where applicable, taxes are calculated and shown by Paddle as Merchant of Record.
  • For generation orders (click purchase), you confirm by completing payment that the creation of the work may begin immediately.

3. Copyright & Licence

The works were created and/or creatively curated/composed by the artist Arno Solaire (artist name). All copyrights and other rights are reserved.

You receive a non-exclusive, non-transferable, non-sublicensable, personal licence to use the works for private purposes only. For security and to protect buyers’ rights, each TIFF file contains the buyer’s Paddle transaction number and session ID. No personal data of the buyer is embedded.

4. Permitted Use

Use of the TIFF downloads (e.g. for prints of paintings, T-shirts, mugs, online galleries, etc.).

4.1 Use without the artist’s SoL signature

  • Permitted for private use (e.g. your own home, private office/workplace).
  • The artist’s SoL signature is not included; the work may be signed by the buyer for private purposes.

4.2 Use with the artist’s SoL signature

  • Permitted for private use.
  • Permitted for public use (e.g. galleries, cafés, shopping centres, museums).

5. Prohibited Uses

  • Public or commercial display, distribution, resale or other use without prior written consent.
  • Integration into media/products intended for resale.

6. Co-exhibitions

  • Co-exhibitions are welcome. The buyer can use the contact form to request a joint exhibition with Arno Solaire (artist and creator of the website) at the buyer’s location.
  • Each co-exhibition is planned individually and requires a prior written agreement.
  • Exhibited works must display a clearly visible “SoL” signature.

7. Provision & Delivery

  • Downloads: The work is generated after purchase and provided as digital content. After payment, the ZIP file containing the TIFF template is made available. The download is available immediately after successful payment. Please check your download folder. A double-click on the ZIP file usually opens it. Technical intermediate steps (e.g. short maintenance windows) may slightly delay provision. If you do not receive a download, please use the contact form. We will then provide the TIFF file by email.
  • Generation orders: You purchase a New-Click package (100, 200, 300 or 400). This means you can create 100–400 new works via the “Neue Kunst” (“New Art”) button. The button shows how many clicks you have left. You decide whether to temporarily save a generated work in your favourites. Only 9 favourites can be stored. If you wish to keep more than 9 works in the favourites gallery, the earliest stored works will be deleted. If you do not want this to happen, you can first purchase a desired favourite by clicking on that favourite. The favourites storage works like a queue: new favourites are added at the end and push the first favourites out at the front.

8. Withdrawal & Refunds

Voluntary refund policy: We grant a full refund within 14 calendar days from the purchase date. The refund applies to digital downloads and to click purchases for the generation of new works and is processed via Paddle as Merchant of Record to the original payment method.

Statutory rights: Statutory consumer rights remain unaffected. The statutory right of withdrawal for digital content may expire if you expressly agree that performance shall begin before the end of the withdrawal period and you acknowledge that you lose your right of withdrawal once performance has begun.

9. User Obligations for Generation Orders

  • You must not use prompts/content that infringe third-party rights, violate laws or our guidelines.
  • You grant us the simple rights of use to your inputs (prompts) that are necessary to carry out the generation.
  • Technical protection measures (to secure click quotas or downloads) must not be circumvented. Copyright law applies (see section 3).

10. Liability

We are liable without limitation for intent and gross negligence; for slight negligence only in the event of breach of essential contractual obligations (cardinal duties). Otherwise, liability is excluded; this does not apply to damage resulting from injury to life, limb or health. The same applies to legal representatives and vicarious agents.

Note: Payment cookies required for purchases via Paddle may be technically necessary. For details, see the “Privacy Policy”.

11. Applicable Law & Dispute Resolution / Jurisdiction

The law of Estonia applies. For contracts with consumers whose habitual residence is in the EU, mandatory consumer protection provisions of their country of residence remain unaffected.

Payment-related matters (billing/refunds/chargebacks) are initially handled by Paddle as Merchant of Record.

Disputes with consumers are primarily handled in writing and electronically (e.g. by email/support ticket).

For business customers (B2B), the exclusive place of jurisdiction – to the extent permitted – is Tallinn, Estonia.
